Our approach to privacy

The following statement relates to our online service provision via this website.

What information do we collect?
We collect personal information to allow us to perform the wide variety of functions and activities for which we are responsible. These are normally specified in or related to the legislation that we administer. Whenever personal information is collected, the Office of Consumer and Business Affairs aims to ensure that you know why we collect it. Personal information is not recorded when you access OCBA's website home page or browse the site, unless you send us an email, complete an online form, or subscribe to our online newsletter.

You should be aware that OCBA collects a record of your visit to our website and logs the following information for statistical purposes - the user's IP address, the date and time of the visit to the site, the pages accessed and documents downloaded, the previous site visited and the type of browser used. No attempt will be made to identify users or their browsing activities except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect our service provider's logs. This information is analysed at the end of each month to determine the site's usage statistics.

How do we use your personal information?
The use or disclosure of your personal information will usually be linked to the purpose for which it was collected. For example, the purpose could be the registration of a business name or the register of an association. The purpose could also be to resolve a consumer complaint, answer a query about a residential tenancy bond or process a transaction for an incorporated association. There are many other examples. In some circumstances we may use or disclose personal information for a different purpose from that for which it was originally collected. This usually happens when we are authorised or required to do so or if we use or disclose personal information for an obvious related purpose. For example, the Office of Consumer and Business Affairs can use or disclose personal information for law enforcement purposes, such as prosecuting an offence under the Fair Trading Act 1987, or occupational licensing law.

Data quality and data security
Every effort is made to ensure that personal information collected, used or disclosed is accurate, complete and up-to-date. We have used our best endeavours to secure office premises and secure information technology arrangements to protect the personal information we hold. These measures complement our other privacy safeguards and help to protect your information from misuse, loss or unauthorised access, and from unauthorised modification or disclosure.

Your personal information will not be disclosed outside of the agency unless the disclosure is authorised by you, or required or authorised by law.
