You are considered to be a building work contractor if you carry on business in connection with constructing, erecting, underpinning, altering, repairing, improving, adding to or demolishing a building or structure, including associated work in excavating or filling a site.
There are four principal classes of building work set out in the Regulations. These are:
- any building work
- light commercial/industrial and residential building work (eg, house construction, multi-storey buildings)
- residential building work (eg, building work limited to houses, additions and alterations to houses)
- other specified building work (eg, trade work - bricklaying, carpentry and joinery, painting and decorating, air conditioning installation, and various other combinations of commercial, industrial and residential building work). Please refer to Section 3 of the Act and Regulation 5 for definitions on building work or contact us for further advice.
Common examples include:
- house construction
- renovations, additions and alterations
- construction or repairs of on-site swimming pools or spas
- paving
- carpentry and joinery
- painting and tiling
- fencing (excluding post and wire fencing)
- installing in-built robes and kitchen cabinets
- construction of retail shops and office buildings and
- installation of air-conditioners.
Plumbers, Gas fitting or electricial work
Any plumbing, gas fitting or electrical work (including work done on your own home) must be performed by a person holding a worker's registration under the Plumbers, Gas Fitters and Electricians Act 1995. A building work contractor's licence may allow you to contract for this work but you must engage a suitably registered worker to perform it.
Licence not required
You are not required to hold a building work contractors licence if you are:- conducting business as a plumbing contractor, a gas fitting contractor or an electrical contractor and are licensed under the Plumbers, Gas Fitters and Electricians Act 1995; or
- conducting business as a pest controller and are licensed under the Controlled Substances (Pesticide) Regulations 1988; or
- installing or maintaining security alarm or surveillance systems and are licensed under the Security and Investigation Agents Act 1995, subject to the condition that any building work that you perform is limited to work authorised by your licence.

Are you considered a Supervisor?
If you supervise the performance of building work (including your own), or act as a supervisor on behalf of a person or company which holds a building work contractors licence, you must hold a building work supervisors registration. You are not required to be a registered supervisor if you are a registered architect.Please refer to Section 3 of the Act and Regulation 5 for definitions on building work or contact us for further advice.
