An alteration to the Rules does not take effect unless registered by CBS (s110(1)).
Application for registration of the alterations under section 110 of the Act, must be made to: Consumer and Business Services (CBS)
Documentation Required
The application to CBS must include:
- Form 6, the approved form for lodging an application to register an alteration of rules
- A printed consolidated copy of the co-operatives rules including the alteration
- The prescribed fee.
Provided that the alteration is not contrary to the Act or the Regulations and provided that there is no other reasonable cause to refuse registration, CBS must register the alterations (s110(3)). If the special resolution has been passed by means of a special postal ballot, CBS will need to be satisfied that the rules of the co-operative specifically permit this to occur (s187(2)). CBS will issue a certificate of registration of the alteration, and a copy will be forwarded to the co-operative.
