Filing for registration

Subsequent to the passing of the special resolution, application for registration of the proposed alterations must be submitted to CBS within 28 days. The approved Form 6 is used for this application and must be accompanied by the prescribed fee.

An alteration to the Rules does not take effect unless registered by CBS (s110(1)).
Application for registration of the alterations under section 110 of the Act, must be made to: Consumer and Business Services (CBS)

Provided that the alteration is not contrary to the Act or the Regulations and provided that there is no other reasonable cause to refuse registration, CBS must register the alterations (s110(3)). If the special resolution has been passed by means of a special postal ballot, CBS will need to be satisfied that the rules of the co-operative specifically permit this to occur (s187(2)). CBS will issue a certificate of registration of the alteration, and a copy will be forwarded to the co-operative.
