Overview

If you are carrying on business under a name other than your own name (without addition), you must register that name as a business name. Adding a word to your name, such as Jill Smith Electrical would require registration of the name.

If you advertise using a name, it is taken that you are carrying on business under that name and registration is required. The name must be sufficiently dissimilar from those of existing businesses and must not mislead as to the true nature or purpose of the business you intend to conduct.

The purpose of business name registration is to establish a public register of information about the business and the proprietor.

When applying to register a business name, you should think of three business names in case your first preference is not available. You may check the register of names for your own reference on the National Names Index

It is your responsibility to ensure that your proposed business name does not infringe any Trade Mark. Check with IP Australia

The final determination on the availability and suitability of the name you wish to register will be made by the Office of Consumer and Business Affairs upon receipt of your application.

Remember: Do not incur any expense eg. printing of stationery until you receive your certificate of registration.

Once registered, your business name is required to be renewed every three years from the date of registration. A renewal notice is issued one month prior to the expiry date with an appropriate fee for renewal notice.

Any change in particulars of a registered business name must be lodged on the appropriate form within 28 days of the date of the change. (Failure to comply will result in a late fee being applicable.)

Internet domain names cannot be registered as a business name unless business is being conducted under the exact domain name being used.

The National Office for the Information Economy, in conjunction with AGIMO and DCITA, has produced a business guide to registering a web address. The guide aims to assist business to register a web address and illustrates the relationship between a company name, business name, domain name and trademark.
