Recreational Services Act

Recreational Services (Limitation of Liability) Act 2002
Prior to 1 January 2011 recreational service providers could only modify their liability for personal injury by registering a safety code under the Recreational Services (Limitation of Liability) Act 2002. A safety code was a list of things that the service provider would do to make the recreational activity reasonably safe for consumers. As long as the service provider notified participants about the code and complied with the terms of the code, the provider was not liable for injuries sustained by participants.

As you may know recreation providers found that safety codes took a lot of time to develop and were difficult to draft. Legislation to repeal the safety code scheme was therefore passed by the South Australian Parliament and came into operation on 1 January 2011.
