Fair Trading Act 1987

In 2002, the National Competition Council (NCC) requested the Government to undertake a desktop review of the Fair Trading Act 1987 (the FTA) pursuant to the Government's obligations under the Competition Principles Agreement.

The NCC has determined that jurisdictions' fair trading legislation does not require review where the legislation largely mirrors Part V of the Trade Practices Act 1974 (TPA). The NCC has taken the view that the consumer protection provisions contained in the TPA are pro-competitive and do not act to restrict competition. Accordingly, this review has not considered the provisions contained in Part 10 of the FTA.

The review focussed on those parts of the legislation which restrict competition or which impose costs or confer benefits on business. Consistent with the Competition Principles Agreement, the review assessed whether the restrictions on competitive conduct contained in the FTA are justified in the public interest.

In accordance with NCC advice, the review was undertaken by the Office of Consumer and Business Affairs as an internal review.

Plumbers, Gas Fitters and Electricians Act 1995

In 1995 the Council of Australian Governments entered into three agreements to give effect to the national competition policy. Pursuant to these agreements, each State and Territory Government is required to review existing legislation that potentially restricts competition. The Office of Consumer and Business Affairs has reviewed the Plumbers, Gas Fitters and Electricians Act 1995 (the PGE Act) as part of this process.

This review was restricted to a review of the Act in terms of its effect on competition. The review was not a general review of the effectiveness of the legislation and issues related to this question were not been canvassed in the review.

The review process involved the release of both an Issues Paper and a Draft Report for public consultation. Using information provided in submissions and further research by the Review Panel, the Final Report has now been prepared. The Government is presently considering the Final Report and its recommendations. A copy of the Final Report is available below.
